These Terms & Conditions (“Agreement”) govern the participation of the guest (“Guest”) in the podcast produced by Recreational Sportz (“Producer”, “We”, “Us”, “Our”). By participating in the podcast recording, the Guest agrees to the terms set forth below:
1. Voluntary Participation
The Guest confirms that he/she is participating in the podcast voluntarily and of his/her own free will. The Guest acknowledges that no pressure, coercion, threats, or undue influence of any kind have been used to induce participation.
2. Originality and Authenticity of Content
The Guest represents and warrants that:
- All content, statements, opinions, and information delivered during the podcast are original, authentic, and based on the Guest’s own knowledge, experience, and expertise.
- The Guest is solely responsible for the accuracy, legality, and veracity of all statements made during the recording.
- The Guest agrees not to include defamatory, unlawful, infringing, or otherwise harmful content.
The Guest understands that Recreational Sportz is not responsible for verifying the factual content of statements made by the Guest and does not endorse any specific claims.
3. Rights and Ownership
All rights, title, and interest in and to the podcast recording, including all video and audio content, shall remain the exclusive property of Recreational Sportz. This includes, but is not limited to:
- Recording rights
- Publishing rights
- Distribution rights
- Editing and post-production rights
The Guest acknowledges that Recreational Sportz has sole and absolute discretion to publish, edit, modify, or withhold the podcast episode, in whole or in part. The Guest agrees that no compensation, royalty, or payment of any kind is owed in connection with use, publication, or exploitation of the content.
4. Copyright and License
By participating in the recording, the Guest hereby irrevocably assigns, transfers, and conveys to Recreational Sportz all rights, including copyright, in the podcast recording. The Guest grants Recreational Sportz the exclusive, perpetual, worldwide right to record, reproduce, publish, distribute, broadcast, and otherwise use the recording, in any format or medium, now known or later developed.
5. Use of Video and Distribution
The Guest acknowledges that Recreational Sportz does not share the video recording with third parties prior to its publication on the Producer’s official platforms, including the website and authorized distribution channels. The Guest shall not distribute, sell, publish, or share the recording independently without express written permission from Recreational Sportz.
6. No Endorsement or Propaganda
The Guest agrees that:
- The podcast content will not contain intentional propaganda, commercial endorsements of any third-party product, service, brand, company, or individual.
- There will be no inappropriate or explicit material, including sexual content or public displays of affection, beyond what is standard for clean, health- and fitness-oriented programming.
The Guest further acknowledges that any mention of products, services, or entities is made voluntarily without any obligation from Recreational Sportz to promote or endorse such entities.
7. Representation and Liability
The Guest agrees that he/she:
- Is solely responsible for all claims, statements, opinions, and information provided during the podcast.
- Releases Recreational Sportz, its hosts, agents, employees, and affiliates from all liability, claims, demands, or actions arising out of or in connection with the content provided by the Guest.
- Understands that the host is facilitating the conversation and is not acting as a specialist in the Guest’s area of expertise.
8. Governing Law
This Agreement shall be governed by and construed in accordance with the applicable laws of India. Any disputes arising hereunder shall be subject to the exclusive jurisdiction of the competent courts in the State of Maharashtra, India.
9. Acceptance
By participating in the podcast recording, the Guest acknowledges having read, understood, and agreed to all terms and conditions outlined in this Agreement.
